JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-03-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 399/402 of the Indian Penal Code and sections 25(1-B)a, 26 and 35 of the Arms Act.

As per the prosecution case, one loaded country made pistol, one live cartridge and mobile phone were recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 2.8.2021. Investigation is complete.
