This application for regular bail arises out of Trial No. 39 of 2022 arising out of Sakra P.S. Case No. 164 of 2022 disclosing offences punishable under Sections-363, 365/34 of the Indian Penal Code and Sections-3/4 of the POCSO Act. Considering the accusation against the petitioner that he along with one Subodh Paswan, kidnapped the informant's minor daughter and she was subjected to sexual assault as emerging from the statement of the victim recorded under Section 164 of the CrPC, I am not inclined to accede to the

Patna High Court CR. MISC. No.60971 of 2022(3) dt.04-03-2023 2/2 prayer for release of the petitioner on bail for the present. Learned counsel for the petitioner has submitted that he is in custody since 23.04.2022. In such view of the matter, it is observed that if there is no substantial progress at the trial, the petitioner shall be at liberty to renew his prayer for bail after six months.

This application is accordingly rejected.
