JUSTICE SUDHIR SINGH ORAL ORDER 10-03-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 323, 307 and 379/34 of the Indian Penal Code.

Allegation against the petitioner is that he assaulted son of the informant. When informant went to rescue his son, he was also assaulted. Petitioner's son assaulted daughter-in-law of the informant and petitioner's wife snatched away silver chain from the neck of informant's daughter-in-law.

It is submitted on behalf of the petitioner that he has got no criminal antecedent. From perusal of the F.I.R. it appears that no date of occurrence and time of occurrence have been mentioned in the F.I.R. Petitioner has falsely been implicated in the present case. There is admitted land dispute between the parties. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on

Patna High Court Cr.Misc. No.58181 of 2015 (2) dt.10-03-2016 2/2 furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri B. M. Tripathy learned Judicial Magistrate-Ist Class, Jehanabad, in connection with Kako P.S. Case no. 129 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
