ANJANA MISHRA ORAL ORDER 18-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in connection with Sasaram Model P.S.Case No.1005/15 for the offence under Sections.408, 409 and 353 of the I.P.C. The allegation against the petitioner is that he had failed to hand over the records of the appointment of teachers for the year 2006-2008. The said records were in connection with the enquiry which was being conducted in view of the direction passed by this Court.

Learned counsel for the petitioner submits that the petitioner had already been relieved from the place from where the records were required to be given on 28.03.2012. In this

No.3007 of 2016 (5) dt.18-04-2016 2/2 connection learned counsel for the petitioner had pointed out Annexure-3 series which is charge report of the petitioner by which he handed over the entire records of the appointments made in the District Education Office, Rohtas to one Ram Kumar Singh Yadav. As such, learned counsel for the petitioner submits that he was no more responsible for handing over the same and that the charge of having retained illegal records is wholly unfounded. Learned counsel for the petitioner further pointed out paragraph 15 of the case diary wherein it has come that the petitioner had actually handed over the aforesaid records to the said Ram Kuwar Singh Yadav on 23.8.2012 itself.

In view of the aforesaid facts and circumstances and the material surfaced in the case diary, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Sasara, in Sasaram (Model) P.S. Case No.1005/15 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
