JUSTICE SANJAY PRIYA ORAL ORDER 08-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Araria P.S. Case No. 333 of 2017 instituted for the offence under Sections-272 & 273 of the Indian Penal Code and Sections- 30, 36 & 38 of the Bihar Liquor Prohibition & Excise Act, 2016.
It is alleged against this petitioner that police on confidential information of keeping illegal spurious Cough Syrup made search and recovered 170 pieces of Eskayf Cough Syrup and also recovered same Cough Syrup from another container and total 590 bottles containing 100 ml each from the house. The petitioner is said to be in custody since 25-05-2017. There is no mention in the written report that any examination was done by the Drug Inspector to confirm that those recovered Syrups were spurious Cough Syrup. In such circumstances, prayer for bail is allowed. The

No.37397 of 2017 (2) dt.08-08-2017 petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Araria P.S. Case No. 333 of 2017 to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Araria subject to condition that both the bailors should be close relative of the petitioner.
