JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-09-2019 The present writ petition has been filed for removal of encroachment over the lands bearing Khata No. 472, Plot No. 3553, 3554 and Khata no. 472, Plot No. 3301.

The learned counsel for the petitioner submits that the land in question is public land and is being encroached by the villagers, hence, the same is required to be removed forthwith. Having regard to the limited prayer made by the petitioner, liberty is granted to the petitioner to approach the Circle Officer, Makhdumpur, Jehanabad by filing an appropriate complaint whereupon the said Circle Officer shall initiate proceedings under the provision of the Bihar Public Land

Patna High Court CWJC No.18095 of 2019(2) dt.03-09-2019 2/2 Encroachment Act, 1956 and after granting appropriate opportunity to the encroachers for filing objections, the Circle Officer shall pass final order under Section 6(1) of the Bihar Public Land Encroach Act, 1956 without any delay. The writ petition stands disposed of on the aforesaid terms.
