====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 28-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Saharghat P.S. Case No. 45 of 2015 corresponding to Sessions Trial No. 58 of 2017 instituted for the offence under Sections-302/34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that mere suspicion has been raised against him. There is no eye witness in the case. One of the co-accused, namely, Allauddin with similar allegation, has been granted bail by a coordinate bench of this court vide order dated 30-03-2017 passed in Cr. Misc. No 6075 of 2017. The petitioner is in custody since 28-102016. From the written report, it appears that the case of this petitioner stands on similar footing to that of co-accused Allauddin

Patna High Court Cr.Misc. No.23191 of 2017 (3) dt.28-08-2017 who has already been granted bail by a coordinate bench of this court.

In such circumstances, prayer for bail is allowed. The petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Saharghat P.S. Case No. 45 of 2015 corresponding to Sessions Trial No. 58 of 2017 to the satisfaction of learned Additional Sessions Judge, Madhubani subject to condition that both the bailors should be close relative of the petitioner.
