JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 05-01-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. Learned counsel for the petitioner is directed to remove the defects as pointed out by the office within a period of four weeks after resumption of normal court proceedings. In the eventuality of non-removal of defects within the undertaken time, office will place the matter before the Bench. The petitioner seeks bail in a case registered for the offence punishable under Sections 399/ 402/ 414 of the IPC as well as sections 25(1-b)a/26/35 of the Arms Act. Earlier, the petitioner was granted regular bail vide order dated 26.08.2021 passed in Cr. Misc. No.18392 of 2021, subject to verification of criminal antecedents but during verification it
Patna High Court CR. MISC. No.71763 of 2021(2) dt.05-01-2022 2/2 was found that petitioner has criminal antecedent, as such, his bail bonds was not accepted. Thereafter, a modification petition to that extent was filed vide Cr. Misc. No.61267 of 2021, but the same was dismissed vide order dated 03.11.2021 by this Court. Now, the petitioner has renew his prayer for bail by the instant bail application.
It is submitted by learned counsel for the petitioner that the petitioner has one criminal antecedent and the same has now been correctly mentioned in para-3 of the bail application. Similarly situated co-accused have been granted bail (Annexure-4 series) and the petitioner is languishing in custody since 22.10.2020, as such, he may be enlarged on bail. Considering the submissions made, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with S.Tr No.77 of 2021 arising out of Chhauradano P.S. Case No.284 of 2020.
