21.01.2015 Even though the Petitioner is present in Court but the Opposite Party No. 2 is absent. This Court had made an effort to settle the dispute but unfortunately it could not happen.

Since the Petitioner seeks quashing on questions of fact which can not be gone into at the stage of Section 482 Cr.P.C, the application is disposed off with liberty to the Petitioner to raise all these points at the appropriate stage in connection with Bairiya P.S. Case No. 139 of 2013 (Tr. No. 918 of 2013) pending before the Chief Judicial Magistrate, West Champaran at Bettiah. With these observations, the application is disposed off.
