The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 498(A), 304(B), 201/34 of the Indian Penal Code.

As per prosecution case, the informant alleged that the petitioner along with his family members used to torture his daughter due to non-fulfillment of dowry demand. It is further alleged that they also killed her daughter after that her dead body was found from dry leaf of Jalkumbhi and soil. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is brother-in-law of the deceased due to which he has falsely been implicated in the present case. The petitioner has no concern mess and business of the deceased as well as her

There is no specific allegation against the petitioner and there is no eyewitness of the alleged occurrence. It is further submitted that the husband of the deceased was already been judicial custody. The petitioner has got no criminal antecedent. Moreover, Similarly situated co-accused namely, Mahendra Yadav has been granted regular bail by a coordinate Bench of this Court vide order dated 23.02.2016 passed in Cr. Misc. No. 5287 of 2016. The petitioner is languishing in judicial custody since 30.04.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Alouli P.S. Case No. 75 of 2014 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. IInd, Khagaria.
