JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 18-12-2018 The petitioners have appeared for Class- Xth Examination, held by the Bihar School Examination Board in 2018. They have a grievance that their answer sheets in at least four papers, namely, Mathematics, Natural Science, Sanskrit and Social Science, have not been duly evaluated. They had applied for scrutiny of the answer sheets. Except for minor change by awarding additional 03 marks in Mathematics paper, in respect of petitioner No. 1, no further change has been found to be required.

Learned counsel appearing on behalf of the petitioners has submitted that the petitioners expect more than what has been awarded to them and in order to satisfy themselves, they

Patna High Court CWJC No.24439 of 2018(2) dt.18-12-2018 2/2 had applied for copies of their answer sheets under the Right to Information Act, which has not been provided by the Bihar School Examination Board. They are seeking direction to the respondent Bihar School Examination Board to produce their answer sheets before this Court.

Since the petitioners have invoked provisions under the Right to Information Act for supply of the answer sheets, the petitioners shall be at liberty to invoke appellate provision provided thereunder, if the Bihar School Examination Board has so far not supplied the answer sheets.

I do not find, on the basis of pleadings available on record, a reason to interfere at this stage.

This application is disposed of with the liberty as noted above.
