Petitioner seeks bail in connection with Powakhali P.S. Case No. 39 of 2019 registered under sections 363, 366, 366A, 120B of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. The present first information report has been lodged after three days of the alleged occurrence without there being any plausible explanation for the delay. From perusal of the allegations levelled in the first information report, no case under the alleged sections is made out against this petitioner. The specific allegation is against co-accused

Patna High Court CR. MISC. No.76418 of 2019(3) dt.18-01-2020 2/2 Manzar Khan. Petitioner has no criminal antecedent. Petitioner is in custody since 17.06.2019.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Kishanganj in connection with Powakhali P.S. Case No. 39 of 2019.
