ANJANA MISHRA ORAL ORDER 22-09-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioner No. 1 is in custody since 06.04.2017 whereas petitioner No. 2 is in custody since 28.04.2017 in connection with a case registered for the offences punishable under Sections 323/324/341/307/34 of the Indian Penal Code, subsequently, Section 302 added.

Learned counsel for the petitioners submits that the allegations against both these petitioners is that they had attacked the deceased with lathi. A similar allegation has been made against one Ranjit Singh that he also attacked with lathi. The said Ranjit Singh is said to have been extended regular bail by this Court in Cr. Misc. No. 8156 of 2015 vide order dated 02.03.2015. Considering the fact that the petitioners are also similarly situated and that they have no criminal antecedent, let

No.43362 of 2017 (3) dt.22-09-2017 2/2 the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Khagaria, in connection with Beldaur P.S. Case No. 81/2014, subject to the following conditions:-

(1) One of the bailors will be their own relative, namely, father, mother, brother, sister and/or their wife.

(2) The petitioners shall not indulge themselves in any similar offence till conclusion of the trial.

(3) The petitioners shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, their bail bonds shall be liable to be cancelled by the learned court concerned.

(4) The petitioners shall co-operate with the investigation, if not already concluded, and make themselves available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail.
