Petitioner apprehends his arrest in connection with Sonbarsa P.S. Case No.235/2016 registered for the offences punishable under Sections 136 of Electricity Act. The written report of the informant goes to show that rail pole has been kept on 01.06.2015 but on 05.12.2016 when the inspection was made by the informant, he found that 43 rail poles were missing and, thereafter, informant lodged the present case. However, it would appear from perusal of the case diary that after more than one year of the alleged occurrence, the case was lodged and in course of investigation some witnesses claimed to have seen the petitioner and others carrying the rail

Considering the aforesaid facts and circumstances of the case as well as submission of the parties, let petitioner in the event of his arrest/surrender within six weeks from the date of receipt of this order to the Court concerned, shall be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) within two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi or his successor in connection with Sonbarsa P.S. Case No.235/2016, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
