====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 15-05-2023 Heard Mr. Shubhesh Pandey, learned counsel appearing on behalf of the petitioner and Mr. Ajit Kumar, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Begusarai Town (Ratanpur O.P.) P.S. Case No. 309 of 2020 registered for the offence punishable under Sections 448 and 385/34 of the Indian Penal Code.

3. As per the allegation made in the F.I.R., accused persons named in the F.I.R. started abusing the wife of the informant and demanded Rs.50000/- as extortion.

4. Learned counsel appearing on behalf of the petitioner submitted that petitioner is the son of the informant. Accused persons named in the F.I.R. had taken some money

No.63163 of 2022(2) dt.15-05-2023 2/2 from the petitioner who is the son of the informant and when they were asked to return money, they came at his house and started abusing his wife and demanded extortion. Petitioner has been falsely implicated in the case. He is not involved in the case in any manner. In course of investigation, not even minuscule evidence has been collected against the petitioner by the investigating authority, in spite of the said fact the name of the petitioner has surfaced in the present case.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

6. Considering the aforesaid facts and circumstances of the case, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Begusarai Town P.S. Case No. 309 of 2020, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
