2. The petitioner seeks regular bail in connection with Khagaria (Gangaur) P.S. Case No. 857 of 2018 registered for the offence under Sections 406, 419, 420, 467, 468/34 of the Indian penal Code.

3. As per prosecution case, the petitioner is alleged to have taken loan from Union Bank of India, Jahagir on the basis of counterfeit paper of Land Possession Certificate (LPC). The petitioners made benefits and committed cheating with the said Bank.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Informant bank has

No.62445 of 2023(2) dt.21-09-2023 2/2 initiated the process of realizing the money through certificate proceeding and the petitioner has been given notice of the proceeding that further the petitioner has deposited an amount of Rs. 24,000/- on 5.7.2023 and the receipt of deposit is being annexed as Annexure-P/2 to this petition. Similarly situated other accused person has already been enlarged on bail by this Bench of this Court vide order dated 12.9.2023 passed in Cr. Misc. No. 60521 of 2023. Petitioner is languishing in judicial custody since 31.5.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the facts and circumstances of the case as well as custody period of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail in connection with Khagaria (Gangaur) P.S. Case No. 857 of 2018 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria. (Sunil Kumar Panwar, J) sushma/- U
