The petitioner seeks pre-arrest bail in connection with Barahara (Khawashpur) P.S. Case No. 98 of 2018 for the offences alleged under Sections 147, 148, 149, 323 and 384 of the Indian Penal Code and 27 of the Arms Act. The learned counsel appearing for the petitioner submits that the petitioner is not named in the first information report as informant, Subhash Yadav, has made specific allegation that 17 persons named in the first information report to cause assault to the labourers of the informant engaged at his brick kiln due to non-payment of Rs.2,00,000/- as ransom and also for chasing the informant, but, with ulterior motive, name of the petitioner has also been disclosed in course of investigation with allegation that the petitioner was also with

Patna High Court CR. MISC. No.56874 of 2019(2) dt.09-09-2019 2/2 them. Petitioner has no criminal antecedent. Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Barahara (Khawashpur) P.S. Case No. 98 of 2018 shall be released on pre-arrest bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
