JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-02-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Bathnaha P.S. Case No. 60 of 2019 for the offence under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 10.02.2019. He submits that in the instant case, the petitioner was arrested along with one country made pistol and 17 cartridges.

Considering the period of custody of the petitioner, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Sitamarhi in

Patna High Court CR. MISC. No.70439 of 2019(3) dt.06-02-2020 2/2 connection with Bathnaha P.S. Case No. 60 of 2019. However, the court below is directed to expedite the trial and conclude the same within a period of six months from today. The petitioner shall attend and cooperate the court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, the court below shall be at liberty to cancel his bail bonds in the present case.
