JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-01-2018 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Counsel appearing on behalf of the petitioner submits that the petitioner was paid salary up to September, 2010 and thereafter without any justification salary of the petitioner was stopped. There is no reason assigned for stoppage of further salary of the petitioner.

In view of the above, the writ petition is disposed of

Patna High Court CWJC No.39 of 2016 (2) dt.03-01-2018 2/2 with direction to the petitioner to file a detailed representation before the Director, Primary Education, Government of Bihar who shall examine the case of the petitioner and if the appointment of the petitioner is found to be legal and valid and if the petitioner is working regularly, the respondent no.2 the Director, Primary Education is required to pass appropriate order for payment of arrears and current salary of the petitioner in accordance with law within a maximum period of three months from the date of filing of receipt/production of a copy of this order. It is made clear that this court has not expressed any opinion on the merit of the claim of the petitioner. With the aforesaid, the writ application stands disposed of.
