JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-12-2018 After some arguments, the learned counsel for the petitioner seeks liberty to withdraw the present petition in order to file objection under Section 9 of the Bihar & Orissa Public Demand Recovery Act, 1914 and till passing of the final order by the Certificate Officer, seeks some protection. Accordingly, the present writ petition is disposed of as withdrawn with liberty to the petitioner to file an objection under Section 9 of the Bihar & Orissa Public Demand Recovery Act, 1914 and if such objection is filed within a period of four weeks from today, the same shall be considered by the Certificate Officer, Purnea in connection with Certificate case no. 513 of 2018-19 and the Certificate Officer shall pass final
Patna High Court CWJC No.24086 of 2018(2) dt.19-12-2018 2/2 order under Section 10 of the Bihar & Orissa Public Demand Recovery Act, 1914. It is further directed that till passing of the final order by the Certificate officer, no coercive steps shall be taken against the petitioner. It is needless to state that in case, no objection is filed within a period of four weeks from today, the Certificate officer shall proceed ex-parte.
