The petitioner has prayed for bail in a case registered for the offence punishable under sections 22/23 of NDPS Act. Prosecution case relates to recovery of 13 bottles of Dialax DC Cough Syrup each 100 ml from a bag, which he was carrying on motorcycle.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. The recovered syrup is not dangerous to human life. Provision of Section 100 CR.P.C. has not been followed by the police officials while preparing the seizure list. The seized motorcycle from spot belongs to petitioner. He is languishing in judicial custody since 3.8.2023.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Madhubani in connection with Ladaniya P.S. Case No. 215 of 2023.
