JUSTICE RAKESH KUMAR ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and Smt. Sharda Kumari, learned Additional Public Prosecutor. The petitioner, who is in custody since 14.6.2017 on an allegation of recovery of about 70 liter mahua liquor from his motorcycle , has prayed for grant of bail in Amba P.S. Case No. 72 of 2017 registered for the offence under section 30(a) and 38 (a) of the Bihar Prohibition and Excise Act, 2016. By way of referring to the statement made in paragraph no. 3 of the petition it was submitted by learned counsel for the petitioner that petitioner is having clean antecedent and was falsely implicated in the case. Moreover , petitioner has remained sufficiently in custody .

Considering the nature of accusation , clean antecedent of the petitioner and period of custody , let the petitioner

Patna High Court Cr.Misc. Case No. 72 of 2017.
