JUSTICE JYOTI SARAN ORAL JUDGMENT Date: 08-01-2018 Heard Mr. Pramod Kumar Singh, learned counsel for the petitioner and Mr. Gyan Shankar, learned AC to GP-2. The grievance of the petitioner is that she was appointed as Aangan Wari Sevika for Centre No.63 in Panchayat Chuwa, Chakia in the District of Jamui but she has not been paid her honorarium.
A counter affidavit has been filed today on behalf of the respondent nos.5 and 6, i.e., the District Programme Officer and the Child Development Programme Officer and at paragraph-6, it is stated that following the appointment, the
Patna High Court CWJC No.41 of 2016 dt.08-01-2018 2/3 petitioner went for training from 9.4.2015 to 10.5.2015 and thereafter, on completion of training she has joined the post on 15.5. 2015. It is stated that the Honorarium for the period from 15.5.2015 to 29.2.2016 could not be paid because the petitioner opened her Bank Account only on 6.5.2016 but for the period subsequent thereto and until October, 2017, the same has been paid to the petitioner. Such is statement made in paragraph-8 of the counter affidavit. It is further mentioned that the answering respondent have made demand for allotment for making payment of the pending dues of the petitioner for the period 15.5.2015 to 29.2.2016. According to Mr. Gyan Shankar, learned AC to GP2, the competent authority to allot the fund for the purpose in the respondent no.3, the Director, I.C.D.S.
Having heard learned counsel for the parties and considering that the major part of the grievance of the petitioner has been redressed and that she is being paid her current Honorarium, in so far the Honorarium for the period from 15.5.2015 to 29.2.2016 is concerned which remains pending for want of allotment, I direct the respondent no.3, Director, I.C.D.S. to take expeditious steps for making available the fund to the respondent nos.5 and 6 for its
