This is an application for bail in connection with Sare P.S.Case No. 36 of 2017 registered for the offences punishable under Sections 30(A), 30(C) and 30(D) of Bihar Prohibition and Amendment Excise Act, 2016.

Allegation as per FIR is of recovery of 60 litres of 'Chowa' as well as liquor manufacturing articles from the place of occurrence and the villagers have named this petitioner as she is manufacturing liquor.

Submission of learned counsel for the petitioner is that petitioner is a lady and has falsely been implicated in this case on the basis of suspicion and due to enmity. Further submission is that she is in custody for about three months. Heard learned APP also.

No.36669 of 2017 (4) dt.30-08-2017 2/2 Having heard both sides and in view of facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-VIcum-Special Judge, Nalanda at Bihar Sharif, in connection with Sare P.S.Case No. 36 of 2017, subject to the conditions that :- (i) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (ii) petitioner shall co-operate in trial and appear in court on each and every date fixed and on failure to appear without any genuine ground or without permission of court, her bail bond shall be cancelled, (iii) If active involvement of the petitioner in such type of cases is found in future, her bail bond shall be cancelled.
