JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and the State. Petitioner is an accused in Samastipur (Mufasil) P.S. Case No. 314 of 2017 for an offence under section 409 and 420 of the Indian Penal Code.
In sum and substance, the allegation against the petitioner is that he has not returned service revolver. From Annexure-2, it appears that vide Samastipur District Order No. 853 of 2017 after a court of enquiry, the petitioner was fasten with the accountability of paying Rs. 100430/- as cost of revolver and cartridges which he could not deposit on attaining age of superannuation.
Having regard to the police order no. 853 of 2017
Patna High Court Cr.Misc. No.37269 of 2017 (2) dt.19-08-2017 2/2 dated 23.06.2017, this court is inclined to enlarge the petitioner named above on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-5, Samastipur or successor court, in connection with Samastipur (M) P.S. Case No. 314 of 2017 on the condition that the petitioner will extend full cooperation in the trial and will not, in any manner, tamper the evidence or influence the witnesses.
