ANJANA MISHRA ORAL ORDER 04-01-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 304 B, 201/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioner No. 1 is the mother-in-law of the deceased whereas petitioners No. 2 and 3 are sisters-in-law of the deceased lady who was done to death for non-fulfilling the demands of dowry. Learned counsel for the petitioners submits that the husband and the father-in-law are already in custody and petitioner No. 1, 2 and 3 had no role to play as is evident from the perusal of the First
Patna High Court Cr.Misc. No.57444 of 2015 (2) dt.04-01-2016 P2/2 Information Report itself. He further submits that they are willing and ready to co-operate in the investigation as and when required. Considering the aforementioned facts and circumstances and the nature of allegation made in the First Information Report, let the petitioners abovenamed, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Sugauli P.S. Case No. 39 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
