JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 12-01-2015 This writ application can be disposed of giving liberty to the petitioner that if he has undergone training for six additional months over and above two years' course offered by Indira Gandhi National Open University which was a special capsule developed by N.C.T.E and which only has been given recognition

Patna High Court CWJC No.22700 of 2013 (3) dt.12-01-2015 2 / 2 of training, then the petitioner can produce such evidence before the competent authority and the competent authority would be required to consider grant of trained scale to the petitioner. Such a position seems to be emerging from communication made by N.C.T.E to the Principal Secretary of Education Department as well as the Vice Chancellor of Indira Gandhi National Open University by virtue of letters dated 22-2-2012 and 22-11-2013. If the petitioner has completed the additional six months of training developed by N.C.T.E under India Gandhi National Open University, then his right to get pay-scale for trained teacher will be made out.

If the petitioner produces such evidence, the concerned respondents will take a decision within three months from such application with supporting certificate and evidence are filed. The writ application is disposed of with the above liberty to the petitioner.
