JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 324, 325, 337, 338, 436, 307, 302, 506 of the Indian Penal Code, Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act and Section 27 of the Arms Act. The accusation is that the accused persons came, started abusing by calling caste name and made assault to the father of the informant and when informant and his family members came to rescue then they were also assaulted by the accused persons. Subsequently the father of the informant succumbed to the injuries.

It is submitted by learned counsel for the petitioner that accusation is not specific against the petitioner and petitioner has no criminal antecedent. A statement to that effect has been made in para 3 of the petition.

Patna High Court Cr.Misc. No.58017 of 2015 (2) dt.04-01-2016 2/2 Considering the nature of accusation, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly the application stands rejected in connection with Dinara(Bhanas) P.S. Case No. 116 of 2013, pending in the Court of learned Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas.
