The petitioner apprehends his arrest in a case filed under Sections 341, 323, 324, 307, 379, 504, 506, 448 and 34 of the Indian Penal Code.
It is contended on behalf of the petitioner that it is apparent that the occurrence took place in view of the fact that she- buffalo of the petitioner's side got injured by the tractor belonging to the informant. It is further contended that so far allegation against the petitioner is concerned, he is only a member of a mob whereas specific allegation of assault is upon co-accused, Birendra Kunwar and Shailendra Kunwar, who had assaulted the

Learned counsel for the informant submits that petitioner is involved in five other cases, however, he could not demonstrate from the first information report that there is any allegation against the petitioner save and except that he was a member of the mob.
Having regards to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in Motihari Muffasil P.S. Case No.334 of 2015, the above named petitioner, Satyendra Kunwar shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran subject to the conditions as laid down under subsection(2) of Section 438 of the Code of Criminal Procedure.
