JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-04-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under sections 25(1-B)a, 26 and 35 of the Arms Act and sections 399 and 402 of the Indian Penal Code. As per the prosecution case, petitioner has been made accused in this case on the basis of confessional statement of co-accused Suraj Kumar Singh who was apprehended on the spot.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No arms and ammunition as well as looted article has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 5.3.2021.
