Earlier prayer for bail of the petitioner was rejected by order dated 27-02-2017 passed in Cr. Misc. No. 379 of 2017. It is mentioned in the aforesaid order that the petitioner has criminal antecedent as six other cases have been registered against the petitioner.

Counsel for the petitioner has submitted that another co-accused namely, Munna Kumar and Lal Mohan Rai have already been granted bail by co-ordinate benches of this court vide orders dated 04-10-2016 & 22-12-2016 passed in Cr. Misc. Nos. 42635 of 2016 & 50466 of 2016 respectively. The case of this petitioner stands on similar footing to that of co-accused. The petitioner is in custody since 18-06-2016.

Patna High Court Cr.Misc. No.38032 of 2017 (2) dt.23-08-2017 Taking into consideration the period, spent by the petitioner in jail custody, prayer for bail is allowed. The petitioners named above are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ghoswari P.S. Case No. 43 of 2016 corresponding to Sessions Trial No. 342 of 2017 to the satisfaction of A.D.J. III, Barh, Patna subject to condition that both the bailors should be close relative of the petitioner.
