2. The petitioner seeks bail in a case registered for the offence punishable under Sections 115(2), 126(2), 118(1), 109, 308(4), 352, 351(2), 351(3), 3(5) of the B.N.S. and Section 27 of the Arms Act.

3. The allegation in the first information report is that the informant was assaulted by the accused persons and upon protest raised by him, the petitioner fired upon the informant but the bullet missed and further one Rohit Yadav fired upon Sidho Yadav which hit on his chest.

4. Learned counsel for the petitioner, at the outset, submits that it would be evident from the first information report itself that the allegation of firing upon Sidho Yadav who is injured in this case is specifically attributable to Rohit Yadav and it is

It is further submitted that the statement of the injured Sidho Yadav has also been recorded in para-67 of the case diary which also reveals that it was Rohit Yadav who had fired shot at him. The petitioner is in custody since 16.06.2025, the charge-sheet has been submitted and the petitioner has clean antecedent.

5. Learned APP for the State has opposed the application for bail to the petitioner on the grounds mentioned in the first information report.

Taking into consideration the facts and circumstances and also considering that the specific allegation of firing at the injured Sidho Yadav is on Rohit Yadav and the petitioner is in custody since 16.06.2025 with clean antecedent, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Beldour P.S. Case No. 121 of 2025.
