ANJANA MISHRA ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Learned counsel for the informant is also present.
The petitioner is in custody since 04.07.2017 in connection with a case registered for the offences punishable under Sections 147/148/149/341/323/307/302/504/506 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that though there has been allegation of multiple attacks on the deceased persons, the postmortem report indicates only one. Such injury on the left side of the head is stated to be is only a swelling (Hematoma) in left side of forehead of wound 4 Inches x4 Inches with multiple laceration on left side of scalp in
Patna High Court Cr.Misc. No.41434 of 2017 (2) dt.21-09-2017 2/2 frontal parietal and temporal region.
Considering the aforementioned facts and circumstances and that the petitioner has clean antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Aurangabad, in connection with Amba P.S. Case No. 9 of 2017, subject to the following conditions:-
(1) One of the bailors will be his own relative, namely, father, mother, brother, sister and/or his wife.
(2) The petitioner shall present himself before the Court blow on each and every date of the trial and shall not absent himself from the trial for any reasons whatsoever without taking permission of the Court.
