JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201, 406, 498A, 120B/34 of the Indian Penal Code.
Petitioner happens to be elder brother in law of the deceased and according to prosecution case itself, the marriage of deceased was solemnized with co-accused, Ramakant Yadav twenty two years back. There is omnibus allegation of torturing and assault against all the F.I.R. named accused including the petitioner. Moreover, the investigation against the petitioner has already been completed and it appears from the impugned order as well as F.I.R. that none has seen the actual killing of the deceased.

No.989 of 2017 (2) dt.16-01-2017 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Gopalganj P.S. Case No. 307 of 2016.
