2. The petitioner has prayed for bail in connection with Pakaridayal P.S. Case No. 217 of 2024 registered for the offence punishable under Section 96 of B.N.S.
3. The case of the prosecution is that the minor daughter of the informant has gone to ease herself in the morning. It is further alleged that the petitioner and others kidnapped her for the purpose of marriage.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. It has further been submitted that the petitioner and the
Patna High Court CR. MISC. No.62930 of 2025(3) dt.22-12-2025 2/3 victim both are of Muslim community and they have solemnized 'Nikah' which is evident from Annexure-P/2. During course of investigation, the victim has given her statement wherein she has stated that the petitioner has kidnapped her in the evening and has taken her in his house for a month. When he told his mother for marriage, she was being ousted from the house. After that, she was kept at the house of petitioner's friend. From perusal of the medical examination regarding age determination, it is clear that the age of victim is about 18-19 years. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 16.06.2025.
5. Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the application for bail. Learned counsel for the informant has submitted that the petitioner and victim both are happily married.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned
