The petitioners apprehend their arrest in connection with Kochadhaman (Bishanpur O.P.) P.S. Case No. 156 of 2018,

Patna High Court CR. MISC. No.57944 of 2019(2) dt.16-09-2019 2/3 registered under Sections 114, 147, 148, 149, 342, 323, 448, 307, 332, 333, 379, 427, 353 and 436 of the Indian Penal Code. The accusation is that on 16.08.2018, Shiwani Sharma and Sidhant Dahia, members of NGO, came at Bishanpur (O.P.) Police Station and informed about slaughtering of cows at Bishanpur Hat, on which, informant along with other police personnel reached at Bishanpur Hat and started to verify the aforesaid information. In the meantime, both NGO members came there and started to take photographs on mobile of that place due to that reason, local persons became adamant and surrounded to both NGO members.

Thereafter, both NGO members were anyhow taken by the police at Bishanpur Out Post but the members of mob surrounded to the police station and asked to hand over the boht NGO members but the police refused then mob started to assault by pelting stones and also damaging the Out Post and motorcycle by setting on fire. At that time, six persons named in the F.I.R. were apprehended and 76 persons named in the F.I.R. including the petitioners were identified in indulging the aforesaid crime.

Learned counsel for the petitioners submits that while the petitioners are named in the F.I.R. but no specific overt act has been attributed against them. Further submission is

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Kochadhaman (Bishanpur O.P.) P.S. Case No. 156 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
