JUSTICE PURNENDU SINGH ORAL ORDER 24-06-2024 Learned counsel appearing on behalf of the petitioner informs that he was communicated vide order dated 19.04.2012 contained in Memo No. 3293 that a detailed order has been passed on the representation of the petitioner dated 21.02.2012, however, the respondents had neither communicated the said order deliberately to the petitioner nor they had provided the order along with the communication contained in Memo No. 3293 and, as such, the petitioner's vital right cannot be denied on the basis of a vague communication contained in Memo No. 3293 dated 19.04.2012.

2. Considering the aforesaid submission made on behalf of the petitioner, as well as, the statement made in

Patna High Court CWJC No.16905 of 2012(5) dt.24-06-2024 2/2 counter affidavit, I find that the impugned order passed by the Managing Director of the Corporation is without providing the petitioner required information. The order contained in 'Annexure-1 to the writ petition' cannot be sustained.

3. The petitioner, if so desire, may file a detailed representation before the Managing Director of the Corporation for reconsideration of his grievances in accordance with law.

4. Accordingly, the present writ petition is disposed of.
