2. The petitioner seeks bail in a case registered for offence under Sections 103, 238, 3(5) of the B.N.S., 2023.

3. Petitioner is not named in the F.I.R. Name of the petitioner surfaced during course of investigation on the basis of his self confessional statement recorded before the police, which has got no evidentiary value in the eye of law. Except confession, there is no other evidence to show complicity of this petitioner in the alleged occurrence. Petitioner has got clean antecedent and is in custody since 17.01.2025. Chargesheet has been submitted.

4. Learned A.P.P. for the State vehemently opposed the bail petition.

Considering the period of custody and clean antecedent, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Bettiah, West Champaran in connection with BMK GRP P.S.
