The petitioner apprehends his arrest in connection with Bheldi P.S. Case No. 23 of 2014, registered for the offences punishable under Sections 341, 307, 504, 34 of the Indian Penal Code.
The petitioner is named in the First Information Report, but after investigation the petitioner was not sent up for trial and against him final form was submitted showing him innocent, but later on cognizance has been taken, resulting, the petitioner is apprehending his arrest or custody after surrender. Submission is of false implication and that this is a false case only with a view to put pressure to marry with co-
Patna High Court Cr.Misc. No.1559 of 2017 (2) dt.17-01-2017 2/2 accused and, as such, the petitioner deserves sympathetic consideration.
The learned A.P.P. fairly submits that after completing investigation the petitioner was not sent up for trial. In the facts and circumstances as stated above, considering that after competing investigation the petitioner was not sent up for trial and, as such, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Saran at Chapra, in connection with Bheldi P.S. Case No. 23 of 2014, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
