2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 323, 324, 307, 354(B), 379, 504, 506/34 of the Indian Penal Code.
3. Petitioner is said to have assaulted the injured person.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is case and counter case between the parties. He submits that the both parties are co-villagers. He submits that occurrence took place on 26.04.2024 but the FIR has been lodged on 05.05.2024 after delay of about 10 days without explaining any reasonable cause of delay. He submits that after investigation, it is found that the persons of both
Patna High Court CR. MISC. No.64106 of 2024(2) dt.01-10-2024 2/2 parties got injury after the incident. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application.
5. Learned APP for the State and informant vehemently opposed the prayer for bail.
6. Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Narpatganj P.S. Case No. 248 of 2024.
