The petitioners are apprehending their arrest in a case registered under Sections 323, 504 and 353 of the Indian Penal Code.

Allegation is that the accused persons assaulted the informant and other police personnel with slaps and they caused hindrance in discharge of their official duties. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the

Patna High Court Cr.Misc. No.55391 of 2016 (3) dt.11-01-2017 2/2 petitioners. The petitioners have falsely been implicated in the present case. All the Sections are bailable except under Section 353 I.P.C. General and omnibus allegation has been made against the petitioners. No specific overt act has been alleged against them. The other co-accused have been granted anticipatory bail vide Cr.Misc.No.54163 of 2016.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Baligaon P.S. case No.68 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
