2. Petitioner seeks regular bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Amendment Act 2022 .

3 . As per the prosecution case, 70 litres country made liquor was recovered from motorcycle of this petitioner.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner and he has been made accused only on suspicion . Petitioner is in custody since 29.07.2024 . 5 . Learned A.P.P. for the State vehemently opposed the bail application .

6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 4 Gaya in connection with Chakand P. S. Case No. 70 of 2024 .
