This application for regular bail arises out of Arwal P.S. Case No. 54 of 2019, disclosing the offence under Section 394 of the Indian Penal Code.

Learned counsel for the petitioner contends that the petitioner was not named in the First Information Report and his name has surfaced in course of the investigation based on confessional statement of co-accused Raj Kumar Singh @ Raju and Shashi Kant. The said Raj Kumar Singh and Shashi Kant have been allowed regular bail by this Court by an order dated 20.11.2019 passed in Cr. Misc. 58342 of 2019. He has submitted that the said confessional statement of co-accused has not led to

He contends that there is no recovery of any incriminating material from the petitioner's possession. Considering the above submission and the fact that the persons on whose confessional statement, the petitioner came to be implicated, have been allowed regular bail by this Court, this application is allowed. Let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand), with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal, in connection with Arwal P.S. Case No. 54 of 2019, subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail Bonds shall be liable to be cancelled.
