This writ application has been filed by daughter-inlaw of late Rama Prasad Singh for payment of 90% provisional pension, 100 % group insurance, 90% provident fund amount, 90% gratuity, 100% earned leave amount and revision of pension from 01.01.1986, out of that, Rs. 20,000/-+ Rs. 68,000/- has already been paid.

Counsel for the State in paragraph 6 of the counter affidavit has given the details of payment of group insurance, GPF amount, Gratuity, family pension and in paragraph 7 of the counter affidavit, specific statement has been made that during

Patna High Court CWJC No.24247 of 2018(2) dt.15-06-2020 2/2 life time of the employee, all the retirement benefits have been paid and since wife of the deceased employee is not alive, as such, question of family pension does not arise. This fact has not been controverted by counsel for the petitioner. In such view of the matter, this petition is dismissed. (Shivaji Pandey, J) V.K.Pandey/- U
