JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2017 The petitioners are apprehending their arrest in connection with Fatehpur P.S. Case No. 113 of 2016, registered for offences punishable under Sections 409, 201, 408/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that the petitioners happen to be the Panchayat Secretaries and have been falsely implicated in this case, the documents in relation to appointment of Panchayat Teacher have already been deposited by them before the competent authority, which is annexed as annexure -2 to this application. It has further been submitted that other similarly situated persons have already been granted the privilege of anticipatory bail by this Court vide order dated

Patna High Court Cr.Misc. No.964 of 2017 (4) dt.20-02-2017 2/3 11.01.2017 passed in Criminal Miscellaneous No. 634 of 2017. Heard learned A.P.P. also Having heard both sides, in view of the submissions of learned counsel for the petitioners that now the documents relating to appointment of Panchayat Teachers have already been deposited and other similarly situated persons have been granted bail by this Court, let petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM -X, Gaya in connection with Fatehpur P.S. Case No. 113 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. This is further subject to the condition that:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioners shall cooperate in the investigation and make themselves available as and when required by the police and on

Patna High Court Cr.Misc. No.964 of 2017 (4) dt.20-02-2017 3/3 the event of failure on their part to appear before the police on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of their bail bonds.

It is also made clear that if during the investigation of the case, any serious materials comes against these petitioners, their bail bonds will be liable to be cancelled.
