Heard learned counsel for the petitioner as well as learned APP for the State.
In this case, the petitioner is seeking regular bail in connection with Bettiah Muffasil (Manuapul) P.S. Case No. 551 of 2018, registered for the offences punishable under Sections 379, 413, 414, 201 of the Indian Penal Code.
It is a case of motorcycle theft.
Learned counsel for the petitioner has submitted that co-accused Sujit Kumar and Saheb Kumar got arrested at the spot. He has further submitted that Shaheb Kumar in whose confessional statement the name of the present petitioner has figured have been granted bail by the coordinate bench of this Court. The petitioner is
Patna High Court CR. MISC. No.474 of 2022(2) dt.31-05-2022 2/2 under custody since 29.09.2021.
Considering the above-mentioned facts and circumstances of the case, the petitioner above-named is directed to be released on bail after framing of charge on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Muffasil (Manuapul) P.S. Case No. 551 of 2018.
The learned trial court is directed to expedite the trial and take every endeavour to frame the charge within a period of three months.
Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
