2. Petitioners seeks bail in a case registered for the offence punishable under Sections 304Band 34 and other ancillary sections of the Indian Penal Code . 3 . It is a case of dowry death . It is alleged that the marriage of sister of informant was solemnized with this petitioner in the year 2021 . And after sometime of marriage , this petitioner along with other co-accused persons named in the FIR tortured and harassed the victim for non-fulfillment of demand of dowry and finally committed murder of sister of informant by tiding a rope around her neck .

4. Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case

Patna High Court CR. MISC. No.65539 of 2024(2) dt.06-12-2024 2/2 because he happens to be husband of the deceased. Petitioner has not committed any offence as alleged. Petitioner is in custody since 01.06.2024 .

5 . Learned counsel for the State opposes the bail petition and submits that petitioner is husband of the deceased and there is specific allegation that he along with other coaccused persons committed torture for dowry and later on killed the victim by tiding a rope around her neck . Deceased died within seven years of marriage at her matrimonial house in an unnatural circumstances.

6. Considering the nature of accusation and the fact that petitioner is husband of the deceased and deceased died at her matrimonial house within seven years of marriage in an unnatural circumstances, prayer for regular bail of petitioner is rejected.
