2. The petitioner has preferred this application for grant of regular bail in connection with Motihari Cyber P.S. Case No. 92 of 2025 dated 15.06.2025 registered for the offences punishable u/ss 318(4), 319(2), 338, 336(3), 340(2), 303(2), 61(2), 317(5), 317(4) and 111 of the B.N.S. and Sections 66C and 66D of the I.T. Act and Sections 25(1-B)26 and 35 of the Arms Act.

3. As per the prosecution case, the informant alleged that there is an Online complaint of financial fraud of Rs. 50,000/- on the mobile no. 9162687392 of the petitioner and from the possession of the petitioner, the mobile, laptop, bank

It is further alleged that the petitioner is involved in this business by one Pappu Kumar and he received cyber fraud money of amount approximately Rs. 80,00,000/- in his SBI A/c No. 37585596829. It is further alleged that the master mind are the co-accused persons namely, Satyam Saurav and Ayush Kumar and the other accused persons are also involved in the business of cyber fraud.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has been made accused in this case merely on suspicion. Learned counsel has further submitted that the co-accused, Pappu Kumr sent Rs. 50,000/- in the account of the petitioner through online and took the said Rs. 50,000/- in cash from the petitioner. The petitioner has not committed any cyber fraud as alleged in the F.I.R. Nothing has been recovered from the conscious possession of the petitioner. The recovery of laptop, cheque book and passbook belonged to the petitioner as stated in para 11 of the bail petition. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 16.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran at Motihari in connection withMotihari Cyber P.S. Case No. 92 of 2025 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
