The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 341, 323, 406, 420, 498(A), 313, 307/34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.

It is a case of Harassment, abusing, torture and assaulting to the informant by the petitioner and others. It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. It is also submitted that

Patna High Court CR. MISC. No.60250 of 2022(3) dt.23-02-2023 2/3 petitioner is husband of the informant and he is ready to keep his wife with dignity and honor. Petitioner has neither demanded any thing from the informant nor he has tortured her. As far as injury is concerned, there is no visible injury sustained by the victim/informant. This fact is also corroborated vide para 42 of case diary, in which victim has stated that there is no injury report either from private or from Government hospital. Moreover, the petitioner is languishing in judicial custody since 24.8.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Mahila P.S. Case No. 24 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction
