Petitioner seeks bail in connection with Sri Krishnapuri P.S. Case No. 131 of 2017 G.R. No. 3488 of 2017 for offences punishable under Sections 489(b), 489(c), 120 of the Indian Penal Code.
The prosecution case, as lodged by the police personnel, is that during patrolling they apprehended the petitioner along with fake currency notes of different
Patna High Court Cr.Misc. No.43558 of 2017 (3) dt.18-10-2017 2/3 denomination of about 10,000/- who disclosed the name of coaccused Nitesh Kumar. Accordingly, a seizure list was prepared.
It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and is a student of T.P.S. College and he was not aware that the currency notes were fake one. He submits that the said fake currency notes were given to him by one Nitesh Kumar. He submits that charge-sheet has already been submitted and there is no allegation of tampering of the prosecution witnesses by the petitioner and that he is in custody since 16.05.2017. However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record and that the petitioner is just a student and bears no criminal antecedent, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna in connection with Sri Krishnapuri P.S. Case No. 131 of 2017 corresponding to G.R. No. 3488 of 2017, subject to the
